1. Definitions

    1. Client(s) means legal persons, who register themselves on the Application and use it and the Software in accordance with the Terms and this Policy for the purpose of using the Services.

    2. Data Subjects means all natural persons, whose personal data is submitted to PADDYTALK  in connection with using the Application, Software and the Services, including recipients of the Services (clients of the Clients).

    3. Policy means this privacy policy of PADDYTALK as amended from time to time.

    4. Personal data means any information relating to an identified or identifiable natural person (‘data subject’). An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

    5. Processing means any operation or set of operations which is performed on Personal Data or on sets of Personal Data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

    6. Service(s) means a business text-messaging service for sending notifications, alerts, reminders, confirmations and SMS marketing campaigns. Service is rendered via a Website-based SMS platform or by using the Software.

    7. Software means web-based interface, mobile app and other downloadable and integrable software developed and maintained by TextMagic for the purpose of provision of the Services.

    8. PADDYTALK  means PADDYTALK Messenger Indonesia, a limited liability company registered in Indonesia with the registered office at Mirusa Graha, 2nd Floor, South Jakarta Indonesia

    9. Terms means the terms of service of PADDYTALK  that establish the terms and conditions of using the Application Software and Services by the Clients and other users.

  2. Data that PADDYTALK Processes. Objectives of Processing of Data

    1. For the purpose of provision of the Website, Software and the Services, PADDYTALK processes the Personal Data that the Clients provide about their phone number as an identification of their account in the application as part of the service.  

    2. PADDYTALK keeps the register of the Phone Number that it processes in accordance with this Policy.

    3. PADDYTALK processes the Phone Number upon:

      1. One Time PIN to activate the Application and Services by the Clients.

      2. Communication between Clients and/or Data Subjects with other Clients in the support of PADDYTALK  in connection with the Application, Software and Services.

    4. PADDYTALK is a messaging application that sends messages between Clients to Clients by using data connection and have no responsibility of the content sent. By this, PADDYTALK is free and off the responsibility from any kind of fraud, threat or other misconduct and unlawful doings using the application.  

    5. PADDYTALK does not processes any kind of personal data nor content of the Clients to Clients communications. PADDYTALK also doesn't store any of data running in the system of the application. 

  3. Safety Measures for Protection of Personal Data

    1. PADDYTALK does not transfer any Personal Data in this case Client's Phone Number to any third parties.

    2. PADDYTALK uses Phone Number considerably as Personal Data to connect the Client's to the system and as identification of the Clients without keeping the data in the server.

    3. PADDYTALK shall ensure that all its employees, contractors, agents, suppliers and consultants, have no access to the Clients' Phone Number or other Personal Data, and by that any kind of Personal Data sharing done by the Clients are totally beyond PADDYTALK responsibility and all Clients are fully aware of and abide by their legal duties and responsibilities.
